Osage Beach — The Board of Aldermen on Feb. 6 voted to approve Special Use Permit case 416, allowing property owner Richard R. Ellerman to develop up to 30 rental single‑family units on a 2.3‑acre parcel zoned commercial near Lions Road.
City planner Kerri Patterson summarized conditions attached to the permit, including a provision that if the site is redeveloped commercially the SUP becomes null and void, a 30‑day minimum rental requirement (consistent with R3 standards), and a requirement for a fully engineered site development plan addressing sewer, water, streets and drainage. “They’re asking for residential uses, to the point of 30 maximum single family type units on 1 2.3 acre piece of property,” Patterson said.
Why it matters: The project converts commercially zoned land to a residential use under a SUP while preserving an option to return to commercial use if the developer pursues that route. Patterson and planning staff, and the Planning Commission, recommended approval with written conditions to ensure infrastructure upgrades.
Infrastructure and roadwork: Board members discussed required road improvements on Lions Road. Patterson said developers must upgrade the existing gravel street to a hard surface and provide a fully engineered plan; the city will not automatically accept the road into city inventory unless the developer applies and the city approves. Alderman Recker said the road district has been involved in preliminary discussions but stressed the board should not assume district acceptance.
Housing details: Patterson said most units would be roughly 800 square feet and likely two‑bedroom units. The units are intended as rentals and cannot be subdivided for separate sale; a 30‑day minimum rental term was recommended to avoid short‑term vacation uses.
Board action: Alderman Rucker made the motion to approve; Alderman Hoffman seconded. The board voted in favor and the motion passed.
Next steps: The developer must submit engineered site plans meeting city standards and coordinate required road upgrades and utility plans prior to building permits.
