The Auburn Planning Board on March 11 voted to postpone substantive review of the Danville Corner Road housing proposal to April 8 to allow the applicant to provide updated layout, utility plans and clarification on ownership structure after changing the plan from 44 single‑family homes to 42 duplex units.
Planning staff said the city attorney previously provided an interpretation of the zoning language that affected how the project should be classified and reviewed. The attorney’s guidance made it necessary for the applicant to change the proposal from single‑family to duplexes so the submission would conform to the ordinance’s review standards. The applicant’s representative said the developer intends to sell buildings (not individual land parcels) and to retain road and infrastructure ownership; the final ownership model will be clarified in the next submittal.
Multiple public commenters urged clarity. Dana Staples and John Cleveland said the ordinance’s density differences between multifamily and single‑family categories make the interpretation material for review and urged the board to require documentation showing whether units will be sold individually or buildings will be sold and the land retained. Board members urged staff to obtain written legal guidance and suggested a short workshop or training for the board on leased‑land vs. condominium models and a possible ordinance update to clarify duplex definitions.
The board postponed its decision to the April 8 meeting to allow the applicant to supply final engineering, a finalized ownership/maintenance agreement or binding instrument describing how the buildings and land will be owned and maintained, and any other materials required by staff.
