Bernal said the city issued a courtesy notice in early January 2025 and a notice of violation by certified mail later that month; his evidence package included photographs and affidavits of posting.
The owner, who identified himself as Otto, told the magistrate the vehicle had a transmission issue and that a friend had taken his wheels temporarily. Otto said he expected to obtain replacement wheels within the 14-day compliance period. The magistrate advised him to call the code officer after curing the condition so the officer could confirm compliance.
Barnard entered the city's evidentiary file, found a violation of section 7-4-19 (inoperable vehicle), and required compliance within 14 days; a $50-per-day fine will be assessed beginning on the fifteenth day if the vehicle is not repaired or removed.
