Council authorizes cooperation for auction of four forfeited parcels; DA to work with State Lands Division

The Athens City Council approved a resolution authorizing the State Lands Division of the Alabama Department of Conservation and Natural Resources to conduct a public auction of four parcels on Plato Jones Street in which the city holds a partial interest obtained through law-enforcement forfeiture proceedings.
City Attorney reported the parcels are jointly owned in varying arrangements by the City of Athens, the Limestone County District Attorney and Limestone County. Because the District Attorney holds a partial interest on some parcels, the DA must process those parcels through the State Lands Division before the sale can proceed. The attorney said the State Lands Division has advertised a public auction to be held on the courthouse steps at the advertised date and time.
"This is just for us to prove our part of it," the attorney said, describing the resolution as authorizing the State Lands Division to conduct the sale and authorizing the city to recognize the Division's disposition of the property. Council members voted unanimously to permit the sale process to proceed, and they also approved suspending the rules so the matter could move on the advertised timetable.
Council members said proceeds from the sale would be used for law-enforcement purposes as provided in the forfeiture arrangements. The city attorney said he has contacted the Attorney General's opinions division for related guidance and will report back to the council when he receives those opinions.
