The City Commission on March 11 approved a waiver to the CBD parking and circulation standards that will let the Delray Beach Market use rooftop and fourth‑floor areas of its existing garage for valet‑only parking that requires a narrower drive aisle than the code normally allows.
Why it matters: The waiver allows a developer to convert remaining retail space to restaurants by increasing effective on‑site valet capacity without using Atlantic Avenue for valet operations. The added spaces are intended to support daytime and evening restaurant demand in a dense downtown block.
What was approved: The applicant sought a waiver from Land Development Regulation 4.60.9.F.3 to reduce the minimum drive‑aisle width to about 15 feet 6 inches on the fourth floor and rooftop where valet‑only stacked parking will be operated by trained attendants. The applicant said the garage already contains 206 public spaces; the valet plan would add tandem/stacked spaces on the upper levels and provide a longer curbside queue on the east side of Southeast Third Avenue to avoid conflicts on Atlantic Avenue. Valet operations only are planned on the fourth and rooftop levels; the second and third floors would remain available for public self‑parking unless demand requires additional valet deployment.
Consultants and staff said the circulation plan keeps activity off Atlantic Avenue, avoids introducing queueing into main pedestrian corridors, and creates a net gain of parking spaces for the downtown core. Staff confirmed that the applicant will operate a valet agreement and provide ADA accommodations and that the fire department review was completed as part of site plan requirements.
Commission action: After staff and the applicant described circulation and answered questions about employee parking, time‑of‑day operations and safety, the commission approved the waiver (roll‑call recorded as yes by commissioners present). The applicant must operate the valet program as described and return for any future modifications to the master valet arrangement.
