The Committee on Parole on Feb. 11 postponed a revocation hearing for an inmate identified as Thomas after discovering he had been represented by appointed counsel at his earlier preliminary hearing.
At a hearing segment at Hunt Correctional Center, board members confirmed Thomas had paperwork indicating he required and had received appointed counsel because he stated he could not read and write. The panel entered an executive session to consider what effect that prior representation would have on proceeding without counsel.
After the executive session, the board told Thomas it could not continue his hearing that day because his appointed attorney needed to represent him at the revocation proceeding. The attorney was contacted and indicated he would represent Thomas; the board therefore rescheduled the hearing and said Thomas would remain in custody until the matter could be reheard with counsel present.
No merits decision was made at the session; the action recorded was a postponement to allow the appointed attorney to appear at the revocation hearing.
