The Larimer County Board of County Commissioners voted to enter an executive session at the close of the Feb. 18, 2025, administrative matters meeting to "determin[e] positions relative to matters that may be subject to negotiations, developing strategy for negotiators and instructing negotiators related to the acquisition of a public right of way for the tactical improvement projects and for conferences with an attorney for legal advice about process," citing Colorado Revised Statutes section 24-6-402(4)(e) and (4)(b).
Commissioner Jody Shattuck McNally made the motion to move into executive session; the motion was approved 3 to 0 (Kristen Stevens: yes; Jody Shattuck McNally: yes; John Kefalas: yes). Chair Kristen Stevens told the room that "there will not be a decision expected out of this executive session, so we will not be coming back online," and the board adjourned to the closed session.
The motion and statutory citations were recorded in the public minutes; no additional public discussion or formal action on the subjects named in the motion was taken at the Feb. 18 open meeting. The board also stated that no decision was expected to result directly from the executive session.
Motion text (as read into the record): "I move that the Board of County Commissioners of Larimer County move into executive suit[ion], session pursuant to Colorado Revised Statute sections 24 dash 6 dash 4 0 2 4 e and 4 b determining positions relative to matters that may be subject to negotiations, developing strategy for negotiators and instructing negotiators related to the acquisition of a public right of way for the tactical improvement projects and for conferences with an attorney for legal advice about process."
