Flagler Schools to sign release clearing decades-old ITT conveyance language from property titles

Mister Freeman presented an information item asking the board to authorize a release agreement with ITT Community Development Corporation to clear an old public‑land‑dedication/settlement agreement from titles to properties in the ITT area.

The district was approached by a developer whose title search showed an apparent outstanding obligation from ITT to convey property to the school district. Mr. Freeman said the conveyances called for by that decades‑old agreement have already occurred for most parcels and that a recorded release would prevent repeated title‑search questions in future real estate transactions.

Chris Wilson, the district’s concurrency attorney, told the board that the recorded agreement remains in the public record and often appears on title searches across the ITT area. “Many of the conveyances … have already happened, and this document is just out there in record,” Wilson said, recommending the district accept a recorded release from ITT that would remove the agreement’s legal strings from district parcels. Wilson said the agreement affects multiple parcels in the ITT area and that the county is pursuing a similar release for county parcels.

Board members asked whether the release transfers ownership or creates financial obligations for the district. Wilson replied the release would remove ITT’s recorded rights and would not transfer land or create new taxes, insurance, or other costs for the district. Superintendent Moore confirmed the item will return at tonight’s board meeting for a formal vote.

The presentation included an explanation that one Seminole Woods parcel (about 30 acres) listed under ITT conveyances does not currently contain a school site; all other parcels identified in the attorney’s title search already have school sites constructed on them. The matter is informational at this meeting; no district action on the release was taken during the information session.
