Owners of 66–68 Neal Street asked the Sugar Grove Village Board on March 4 for direction on a final plat to divide an existing duplex into two separate parcels to allow one side to be sold.
Staff said the plan commission held the required public hearing and recommended approval, subject to conditions that the two units maintain an identical exterior appearance and that the petitioner install a second utility “buffalo box” or other service as required by the village engineer.
Staff also noted the applicants requested variances because the resulting lots would not meet the village’s minimum lot-width and setback standards for newly subdivided parcels. The plan commission recommended the variances; staff said several similar lots exist nearby and the commission was comfortable with the request.
Trustees and staff discussed enforcement of an appearance condition. The village attorney and staff explained that a recorded covenant or restrictive covenant tied to the property could be used to maintain uniformity and notify future owners. The applicants indicated their attorney advised such a covenant was feasible and that they would record it if required.
