Planning board approves housekeeping UDO amendments to align county code with state law

The New Hanover County Planning Board on March 6 recommended approval of maintenance amendments to the county’s Unified Development Ordinance (UDO) to align local rules with recent changes in North Carolina law.
Planning staff member Farrell explained the amendments were primarily housekeeping and statutory updates requested by the county attorney’s office. Farrell told the board three specific changes: remove local restrictions that would conflict with the state residential building code (for example, language limiting use of shipping/storage containers as ADU building materials); codify the state’s 30-day uniform review process for releasing performance guarantees; and adopt updated statutory provisions governing relocation or replacement of legal nonconforming and on-premises advertising signs.
Board members described the amendments as straightforward and consistent with the county’s comprehensive plan because they keep the ordinance current with state requirements. A motion to recommend approval passed by voice vote.
Next steps: The recommendation will be forwarded to the New Hanover County Board of Commissioners for final action at a future meeting.
