Staff told the executive committee it has identified several lapsed filings and will refile emergency and expedited rulemakings to bring the Washington Administrative Code (WAC) language into alignment.
Dustin said the emergency rule and associated expedited rulemaking for the NAFED (NAFED versus NYSET licensing matter, as discussed) lapsed in February and needs to be refiled, and that the expedited CR-105/CR-102 filings tied to that item also need attention. He said a public-safety-related expedited rule concerning barbecue on patios in the International Fire Code (IFC) lapsed and will require re-filing. Staff also identified family-home childcare rule language: the IRC now reflects a change allowing up to 16 children in certain family-home childcare definitions, but corresponding IBC and IFC language does not yet reflect that and needs to be aligned across codes.
Staff said it will refile the lapsed emergency/expedited items and is developing internal tracking and a notice procedure (gov-delivery) for filings to reduce future lapses. Committee member Ken asked that staff check the record of motions from the November council meeting to confirm whether a CR-102 proceeding for 2021-code-related changes was intended and, if so, that staff bring it to the next council agenda for correction or follow-up.
