Magistrate orders permit application within 30 days after tree-damaged roof found at NW Webster property

Special Magistrate Stephanie Marchman found an unsafe-structure violation at a property owned by DBM Property LLC, after city staff said a tree had fallen through the roof and compromised the structure.
Code enforcement told the hearing the tree fell on Dec. 19 and was still resting on the structure, making it uninhabitable; staff posted an unsafe-structure notice. The city said it wants the owner to pursue either demolition or repair and to submit permit applications within 30 days.
Marchman ordered the owner to apply for permits within 30 days; if no application is filed a $50-per-day fine will begin to accrue and become a lien on the property. The magistrate also awarded the city its administrative costs of $19.28 for certified mailings.
The property representative, Dennis McNeil, told the magistrate the neighbor’s tree fell during the hurricane, that he recently invested substantial money in the house and that he will remove the tree and pursue repairs and permits. Marchman emphasized that maintaining structures is the owner’s responsibility even if the damage came from a neighboring tree and that civil recourse against a neighbor is a separate matter.
