Conservation Commission issues order of conditions for 71 Chanticleer Road

The Sudbury Conservation Commission on Feb. 10, 2025, closed the continued hearing for 71 Chanticleer Road and issued an order of conditions for DEP file 3011430 covering after-the-fact tree removal, patio renovation and restoration plantings within the 100-foot wetland buffer.

The order, prepared by conservation staff Laurie (Conservation staff), requires the applicant to meet with the landscape contractor before work begins, specifies the size of the replacement plantings required for restoration, sets a two-year survival requirement for those plantings and allows the area to naturalize after planting. The order also requires invasive-species management in the restored area. "I would like to meet with your landscape or whoever's doing the work before you start so that we're all on the same page before that work commences," Laurie said when summarizing the order.

Ashia White, the applicant, told the commission she had nothing further to add at the hearing. After discussion the commission voted to close the hearing and issue the order of conditions. Voting members recorded in the meeting were Cook, Bruce Porter, Mark Severe and Dave Henkel; the vote was recorded as unanimous in favor of issuing the order.

The order implements restoration and monitoring measures intended to return disturbed buffer-zone area to vegetated condition and to prevent invasion by nonnative species. Laurie said the order "includes a condition noting the size of the plantings that were required for the restoration, and there'll be a two year clock on those plantings that they need to survive." The commission directed staff to contact the applicant about the administrative details for implementing the order.

No other permits or timelines beyond the two-year survival requirement were specified at the hearing.

The commission handled the matter as a continued application from Nov. 4, 2024, and Jan. 27, 2025; the filing is recorded as DEP file number 3011430.
