Planning commission splits on short-term rental permit for Pacific Avenue property; recommendation goes to council

The Planning Commission considered a conditional use permit for a short-term rental at 903 Pacific Avenue (applicant Patrick A. Bowers) and split on whether to recommend approval.

Several commissioners voiced concern about the applicant's prior administrative notices and fines for short-term rental activity, and asked whether the owner would cease renting until the permit was finalized. The applicant said he had operated the unit at times, paid fines, and now is seeking formal approval and the ability to follow city rules, provide required parking passes for guests and maintain local responsiveness.

During the hearing commissioners and staff reviewed Host Compliance records and the Commissioner of the Revenue records; staff said the unit had documented short-term rental activity through 2024 and that it had not been continuously registered since 2021, so it did not qualify as grandfathered. Commissioners asked whether the applicant would cease renting until council action; the applicant said he intended to follow the process and not rent once notified or once council had made a final decision.

After extended discussion and two competing motions, the commission recorded a tie vote resulting in a recommendation for denial that will be forwarded to City Council. Staff noted that a denial at the commission level can be appealed or resubmitted per ordinance timelines; applicants should consult Planning and the city attorney's office for options.

Commissioners stressed enforceable management and clear, local contact procedures as essential controls for short-term rental permits going forward.
