Champaign County committee renews MS4 stormwater permit notice of intent

The Champaign County Board Environment & Land Use Committee approved renewal of its Notice of Intent (NOI) for the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit covering June 1, 2024, through May 2029 with the Illinois Environmental Protection Agency.
County staff told the committee the renewal is largely procedural while the county continues to await the statewide ILR40 general permit and guidance, which the county has been expecting for about four years. Staff warned that the ILR40, if finalized with the provisions in the 2021 draft, could require additional sampling, including post-storm sampling after events of roughly a half-inch of rain, and could make future compliance more complex and expensive.
Staff also noted the county’s MS4 jurisdiction is limited to the unincorporated portion of the urbanized area and follows county highways, and that most potential new requirements would primarily affect municipal partners. Committee members raised logistical concerns about sampling (for example, access and timing during droughts) and suggested examining options such as using the Urbana-Champaign Sanitary District lab for testing if sampling becomes required. The committee approved the NOI renewal and will return to the board if more complex permit requirements are imposed.
