The board’s discussion focused on whether breathalyzer screenings at optional, after‑hours school events (prom, homecoming, certain rivalry events) are covered by existing policy and how parents are notified. District staff and Timberlake High School staff told trustees the practice has been used for several years and that the student handbook or registration portal currently notifies families that some events use breathalyzers; Timberlake assistant Josh Hanks said parents acknowledge the handbook at registration.
Trustees pressed for three clarifications: explicit policy language stating when parents will be notified, a parent signature or electronic opt‑in in the registration portal, and linkage to the district’s search-and-seizure rules. Legal counsel told the board that court precedent on school searches is mixed but that schools generally may impose certain entrance requirements at optional, school‑sponsored events on school property if applied uniformly and if attendance is voluntary.
Board members also raised constitutional and procedural concerns about nonconsensual searches and the need to state clearly whether ‘reasonable suspicion’ or other standards apply. Several trustees requested removal of qualifying phrasing such as “as applicable under the circumstances” and asked staff to replace it with direct, plain wording that student constitutional protections will be respected and that parents will be notified when school staff take action.
Action taken: The board moved and passed a motion to table policy 3370 to allow staff to add explicit parent‑notification/consent language and cross‑reference the student‑handbook/registration process. Trustees later also moved and passed a motion to table policy 3410 pending rewording to address club‑approval language, gender‑specific athletic language, and parental notice.
Staff said once the revised language is ready they will add the required items to the registration portal so parents must actively sign off on the policies at registration.
