The Elbert County Board of County Commissioners voted to approve Independence PUD Amendment No. 4 (PD-2024-7520), a set of text clarifications that apply to the future Independence filing No. 5 and that do not change land uses or overall density.
Jennifer Jones, Elbert County planning manager, said the amendment covers roughly 377 acres and only clarifies lot-width language and a side-yard setback note; she described the request as "clarifications only, no other changes." The amendment mirrors an earlier change (Amendment No. 3) that had applied to a different filing and seeks to replace ambiguous range language with a clear minimum lot-width standard for the affected area.
Jones told the board the amendment was submitted in September, went through standard review and notice, and generated few comments. The matter was considered by the planning commission, which held a public hearing and voted 6-0 to recommend approval with conditions.
Mark Keefer, planning consultant with Norris Design, explained the amendment’s origin and intent: ambiguous lot-width ranges produced interpretive difficulties—particularly for curved streets and cul-de-sacs—so the applicant and staff agreed to adopt a minimum width standard to remove ambiguity. Keefer said densities remain the same and most existing single-family lots in Independence fall into the standard single-family and large single-family categories.
Jones said the amendment also includes a clarified side-yard setback definition that would apply to duplex lots in the PUD; she noted that there are currently no duplex plans for the affected filing but that the clarification anticipates future options allowed under the existing PUD.
The board opened the public hearing, received no public comment, and approved the amendment with the standard three conditions: removal of the public hearing sign within seven days, effectiveness tied to payment of fees and recording, and recordation within 180 days. The motions carried by voice vote.
