The Orange Beach City Council on Jan. 28 moved to consider and advance an amendment to Ordinance No. 172 that would convert the Lost Bay Townhouses development from condominium ownership to a townhouse (fee‑simple) subdivision.
Griffin (city staff) told the council the project, approved by site‑plan review in October 2022, is already under construction and that “the request is to convert this from as it was approved under a condominium ownership to, townhouse subdivision that will allow for fee simple ownership of the units.” Griffin said one building is visible from Canal Road and that the application seeks PUD deviations needed for the ownership change rather than changes to the site layout.
The presentation said the development proposes 82 units with typical lots about 20 by 70 feet, a 19‑foot front setback, a 5‑foot rear setback and no side setbacks typical of townhouses. Staff said parking would exceed the two‑spaces‑per‑unit requirement (an attached garage plus two driveway spaces per unit was shown). The applicant also asked to reduce the right‑of‑way width to 36 feet (26 feet of roadway with a 5‑foot sidewalk on each side).
Griffin said the project meets four of the PUD’s 12 design objectives and that the developer has submitted a preliminary/final major‑subdivision application, which the planning commission will consider at its February meeting.
Council members used unanimous consent to suspend the rules and allow immediate consideration of the ordinance. The transcript records a roll‑call style vote in which each council member recorded “Yes” on the suspension vote; the council then moved forward with the ordinance question.
What happens next: the planning commission will review the preliminary/final subdivision documents at its February meeting, and final subdivision approvals will be required before the change to fee‑simple ownership can be recorded.
The council did not discuss any additional conditions or changes to the site layout during the Jan. 28 meeting; Griffin said no site layout changes were proposed.
