Board discusses revising mandatory sewer tie-in rule to exempt Title 5-compliant systems

Kevin (member) said he would like to change the town's mandatory sewer tie-in rule so properties with septic systems that pass a Title 5 inspection would not be forced to connect to sewer lines. "I'd like to change that, and they wouldn't be forced to tie in if the septic's good, if it passes Title 5," Kevin said.
Board members and staff reviewed a prior vote recorded in the minutes from May 2016 that established the current mandatory tie-in requirement. Kevin and Colleen discussed clarifying that properties served by cesspools would still be required to tie in regardless of a Title 5 result; Kevin said "cesspools ... they're gonna have to tie in because not many are gonna pass anyway."
Colleen (staff member) said she can draft revised regulations in the town's regulatory format and suggested running the draft by town counsel before presenting it to the board. The board discussed including a disciplinary process or statutory fines for failure to tie in and agreed staff should prepare a draft that addresses enforcement and fines.
No vote was taken; the board directed staff to prepare draft regulations and, as discussed, to have town counsel review the draft before returning it to the board for consideration.
