Why it matters: The UDC, adopted in May 2023, included a requirement that the code be reviewed every six months for two years. Staff said this will be the fourth review and that amendments are still being developed; none of the dates or proposed amendments are final, Hernandez said.
Commissioners asked staff to review several recurring issues. One commissioner said, “I'd like to see if they could go back into where the discussion was of maybe going to permitting instead of special use,” referring to the regulatory approach for smoke shops; staff confirmed that topic is under review. Another commissioner asked staff to revisit a five-foot setback provision for house rear wings. A commissioner noted he is coordinating with “Mr. Holman and their group” and asked that those items be included for review.
Staff said recommended amendments would be provided to the commission and council ahead of the joint hearing, likely in April. The commission also confirmed joint hearings have typically been scheduled in the evening and asked about remote participation; staff said members must attend in person for the proposed joint hearing.
