Coroner discusses TransUnion (TLO) service agreement and liability language; county counsel to review

The LaSalle County coroner briefed the committee on the office’s long‑standing use of a TransUnion product called TLO and raised a contract liability issue raised by the State’s Attorney.
The coroner said the office pays roughly $900 per year for the web‑based service, which the office uses frequently to locate next of kin, social‑security information, phone numbers and addresses. After paying the annual fee in January, TransUnion sent a service agreement the county was asked to sign. The coroner forwarded the agreement to State’s Attorney Pat Herman for review. Herman flagged a provision that would limit TransUnion’s liability to the annual fee amount, which the coroner and attorneys said does not meet county liability requirements.
“Pat … said the main concern … is that their liability for TransUnion is only limited to the amount that we pay each year,” the coroner said. “So in other words, if something went by then the county would be only up to $900.”
The coroner said county IT staff reviewed the system and had no operational concerns; the IT administrator noted two‑factor authentication and administrative controls for users. The committee discussed whether to negotiate the vendor’s liability language or explore alternative vendors. The coroner said Ottawa Police had switched vendors in the past for pricing reasons and that he could trial another vendor at no cost.
Committee members agreed the coroner should continue working with the State’s Attorney to resolve the contract language and then proceed as advised. No formal committee vote to sign the TransUnion agreement was recorded.
