Staff said the proposed easement language was reviewed by the village attorney and was revised to prohibit permanent fencing within the easement and to require the utility companies to coordinate work with the village to avoid disruption to adjacent baseball fields. Staff also noted the easement contains language that could limit the village’s ability to alter grading within the easement strip; staff said there are no current plans to regrade the easement area.
Trustees asked whether the parkland is village-owned (staff confirmed it is) and whether the easement would limit future uses — for example, a previously discussed dog park — in the park. Staff replied the easement runs roughly 12 feet behind abutting properties and is located near the baseball fields rather than in large open areas used for other park uses; trustees said they wanted to avoid restricting future park improvements and asked staff to keep that in mind in final documentation.
A motion to approve the permanent distribution easement passed by roll call.
