Planning commission recommends approval of Jerry Williams preliminary major plat in Dickinson extraterritorial area

The City of Dickinson Planning and Zoning Commission on Feb. 12 recommended approval of PLP-001-2025, the Jerry Williams Subdivision preliminary major plat, for roughly 35.66 acres in the city's extraterritorial zone.
The plat covers a portion of the Southeast Quarter of Section 22, Township 139 North, Range 96 West of the Fifth Principal Meridian and is zoned agricultural. Staff told the commission the applicant intends the subdivision to divide the tract into appropriately sized lots for the residents currently living there; no new lots for future development were proposed at this stage.
City Planner Natalie Burcheck said the proposal's "primary purpose is to be used as residential. There's, I believe, 2 lots on kind of the Southeast corner that currently have some stables on them, and those will continue existing. That's a permitted use in agricultural. So, but that's the purpose of it is just to divide for the residences that are already there." Burcheck also told commissioners staff recommends approval.
A member of the public, Rita Tomchuck, asked whether the land would remain agricultural or be used for residences. Tomchuck said, "My name is Rita Tomchuck. My concern is I really don't understand where it's What it What's it going to be used for resident or continue agriculture? I didn't quite catch that." After Burcheck and the applicant clarified the intent, the commission moved to act.
Commissioner Johansen moved that the Planning and Zoning Commission recommend approval of PLP-001-2025 as meeting Dickinson Municipal Code requirements and protecting public health, safety and welfare; the motion was seconded by Commissioner Decker. After a public hearing and no further public comment, the commission approved the preliminary plat by voice vote. Staff said a contract for maintenance of the road serving the subdivision has not yet been submitted and must be provided with the final plat submittal.
The preliminary approval returns to the commission at final plat submittal; the road maintenance contract and any required engineering or utility assurances must be provided then.
