The House Rules Committee gave House Bill 2264 a do-pass recommendation after sponsor Representative Miller said the bill limits when a homeowners association may foreclose on an assessment lien.
Representative Miller explained the bill “gives more latitude to the homeowner, essentially. So the bill would restrict the ability of a HOA to foreclose on an assessment lien whether that was for dues or fines, including attorney fees, until such time as HOA has attempted to collect otherwise.”
