Commission approves facade agreement for Del Mar/Viceroy project after neighbors reach compromise on kinetic wall

The agreement, read into the record by attorney Stephanie Toothaker on behalf of the Viceroy, designates the manufacturer (X Tek) and the kinetic system (Kinetic Wall), requires 40% open natural ventilation for the side facing the Del Mar, and includes design parameters such as an "ARQ-designed" motif with up to 35 unique colors. The kinetic panel system will cover the vertical and horizontal area facing the Del Mar, top three floors of the garage overlooking the Del Mar amenity deck, and will extend past the edge of the Viceroy building to complete the panelized system. The developer (the Viceroy) will pay all manufacturing and installation costs, and installation must be complete before a final certificate of occupancy.
Jake Wozak, representing 299 North Roadmaster and the Del Mar owner, told the commission he consented to the terms and asked that images of the proposed installation be entered into the record. Ella Parker, urban design and planning manager, confirmed that the submitted renderings and elevations meet code.
