Sen. Missy Irvin advances bill allowing LP gas board to adopt NFPA 58 by rule

Senator Missy Irvin, R–District 24, told the Senate Agriculture, Forestry & Economic Development Committee that Senate Bill 275 would permit the Liquefied Petroleum Gas Board to adopt the nationally recognized safety requirements contained in National Fire Protection Association (NFPA) 58, 2020 edition, by administrative rule.
"What this bill does is it enables the LPGB to adopt by rule the requirements of nationally recognized safety standards of national fire protection of national fire protection pamphlet 58, which is the 2020 edition, regarding the storage handling transportation and use of liquefied petroleum," Irvin said. She said adopting the NFPA standard by rule would streamline and standardize Arkansas's liquefied petroleum rules and "reduce the burden on the industry."
The bill would allow the Liquefied Petroleum Gas Board to incorporate NFPA 58 standards through the rulemaking process subject to public comment and Administrative Legislative Council review, and would repeal statutory provisions the bill drafters deem unnecessary.
Irvin told the committee the change "will positively impact permit holders' ability to secure employment of trained individuals, and it allows enhanced industry training which will promote consumer and industry personnel's safety." She said the proposal has the support of the LP gas board and the Arkansas Propane Gas Association and that industry representatives were present at the hearing.
After brief committee discussion and no members registering opposition, the committee approved the bill by voice vote. The committee chair called for those "in favor say aye," and the bill was advanced.
