The City of Montgomery Planning and Zoning Commission on March 4 voted to recommend that City Council approve a variance request for Lots 27 and 28 in the Hills of Town Creek Section 5 development to reduce the previously approved 50‑foot minimum width at the 30‑foot setback line to 45 feet.
Planning staff explained the change will modify two lots to provide access to a reserve so that neighborhood lots can reach the green space behind the lots. Staff said the reserve is usable open space that contains a waterway easement and that the proposed modification maintains minimum lot areas of roughly 10,000 and 8,000 square feet for the two lots; the approved PD and building setbacks will continue to apply. Staff recommended no objection to the variance because it improves access to green space and clarifies easement access for the city.
Commissioners noted the applicant will still need to complete a replat to record the change and that the council will make the final decision. A motion to recommend approval to City Council was made, seconded and carried.
The commission recorded the recommendation; staff said the next procedural step is City Council consideration and then replatting paperwork to finalize the change.
