Committee passes bill restricting HOA foreclosures until other collection efforts are tried

Representative Miller presented House Bill 2264 and said the bill “gives more latitude to the homeowner” by restricting when a homeowners association may foreclose on an assessment lien for dues or fines, including attorney fees, until the HOA has otherwise attempted to collect.
Miller said the bill would require an HOA to try other collection methods before initiating foreclosure on an assessment lien. The committee adopted the PCS as a working draft and voted to report the bill as due passed.
