The Greenwood Board of Zoning Appeals on Feb. 24 approved a dimensional variance reducing the required front setback from 60 feet to 29 feet for a proposed grocery on the 1100 block of South Park Drive.
Donna Smithers of Northpointe Engineering and Surveying presented the petition as representative for DT Real Estate 63 and said the layout aligns the new building's front with the existing Sam's Club frontage and shifts parking to the rear to make the site work. She described the proposal as a proposed grocery store whose front faces Lehi and said the petitioner had supplied a detailed statement of reasons for the record.
Staff recommended approval with two conditions: (1) the final plan must conform to the site plan and building elevations shown in exhibits C and D, and (2) approval is contingent on clearance from the Federal Aviation Administration; the staff report cited Indiana Code 8-21-10-3 regarding hazard to air navigation as the governing statutory reference for the FAA clearance requirement. The petitioner indicated agreement with both conditions.
Board members asked clarifying questions about orientation and use; Ms. Smithers said the building front would align with Sam's Club and that utilities and parking influenced how far forward the structure could be placed. A motion admitting all evidence was approved 5-0. Mr. King moved to approve the 60-to-29-foot setback reduction with staff's two conditions; Mr. Milborne seconded and the motion carried 5-0. The board then directed corporation counsel to draft written findings of fact; that motion carried 5-0.
Ending: The decision is subject to FAA clearance and the petitioner must complete further site and elevation review through the planning department; the board will take final legal action after counsel files the findings of fact.
