Council approves $266,100 settlement in construction procurement case; members ask for follow-up briefing

The Chicopee City Council on Feb. 18 approved a $266,100 appropriation to settle litigation brought by Gagliarducci Construction against the city, the Chicopee School Department and a school official, according to a settlement memorandum circulated to councilors.
City Solicitor Kevin Corden told the council the litigation “arose out of a flawed procurement process” and recommended the settlement as in the best interests of the city. “It contemplates the best interests of the city, the taxpayers and its employees,” Corden said.
Councilors raised questions about transparency and follow-up. Several members asked for — and were told how they could obtain — further details in executive session once the settlement was approved. Councilor Costello asked whether the matter should be discussed in executive session so the council could “be privy to information” about procedures and accountability. The solicitor and president explained that an executive session would need to be posted separately and could be scheduled later to review details not appropriate for open session.
Why it matters: The settlement stems from procurement procedures connected to school maintenance work; councilors said they want to ensure the same procurement errors do not recur, and to understand whether departmental processes need changes.
Councilors voted to approve the settlement appropriation. The roll call recorded the motion as passed.
