Panel approves bill to exempt active-duty military pay from Georgia income tax

The Ways and Means Committee voted to move HB266, which would exempt active-duty military pay from Georgia state income taxation. Representative Sainz presented the bill, telling the committee Georgia is one of five states that currently taxes active-duty pay and that aligning with the majority of states would allow service members stationed in Georgia to declare state residency without tax disadvantage.
"This would simply put us in line with [the] majority of states who exempt this," Sainz said. He noted he did not have a fiscal note at the subcommittee hearing but told members the measure would likely not have a large fiscal impact because of federal-military filing behavior.
Representative Prince questioned residency mechanics for stationed service members and Sainz confirmed the measure would apply to individuals stationed in Georgia who elect Georgia residency.
The subcommittee and full committee carried the bill by voice vote.
