Powell County Commissioners convened a special meeting in February 2025 and entered an executive session with the county prosecuting attorney’s office to discuss potential litigation; the board recessed into closed session and, upon returning, took no action.
The meeting’s organizers said the discussion would address litigation in which the county was likely to become a party. The commissioners voted to go into executive session until 1:15 p.m.; the motion was moved and seconded and approved by voice vote. County officials said no action would follow from the closed session.
During the opening of the meeting a motion was made and seconded to convene the executive session for the stated purpose of consulting with the prosecuting attorney about potential litigation. The board recessed into closed session at the declared time and returned at about 1:15 p.m. At the reconvening the chair announced that the executive session had addressed potential litigation and that no action would follow that day.
Attendees named during the meeting included Commissioner Mike French; Commissioner Mark Herzayas; Commissioner Randy Johnson; County Administrator Tom Milke; Tammy Solinger, HR and risk management; Monica Anderson, interim IT director; Jesse Major, public records officer; Tim Hebble, chief deputy director, PCD; Bruce Emery, director, DCD; Steve Albino, prosecutor's office; and Jay Reno, civil deputy. The motion to enter executive session and the voice vote were recorded on the meeting record; individual roll-call votes were not recorded in the transcript.
The meeting was convened solely to permit confidential consultation with legal counsel under the executive-session allowance for litigation strategy; no formal decisions, motions adopting policy, or public actions were taken when the board returned to open session. The special meeting was then adjourned.
