The Oconee County Board of Zoning Appeals voted unanimously to approve a 4.5-foot variance from the five-foot rear setback for a raised patio at 831 Dogwood Cove Drive in Seneca.
The variance, filed as application VA25000001 (TMS 27000-01-023), was requested by contractor Matt Kanaghi of Kanaghi Construction on behalf of property owners Fred and Denise Hopper. Kanaghi told the board the proposed patio would be kept flush with the home's basement level so the owners would not need steps and to preserve their outdoor living space.
The board said the application met the four findings required under the county's zoning chapter for a variance. Board members moved in the affirmative on each finding — that extraordinary conditions exist on the property, that the conditions are not generally applicable to other properties in the vicinity, that application of the chapter would unreasonably restrict use of the property, and that granting the variance would not substantially harm adjacent uses or the public good — and then voted to approve the variance. The board recorded the vote as unanimous; individual roll-call tallies were not specified on the record.
Kanaghi described site conditions that he said necessitate a raised structure: the lot slopes toward Martins Creek on Lake Harville and, he said, one side of the patio would require roughly a 3- to 3.5-foot stem wall. He said the proposed patio would run approximately 30 feet. Kanaghi also said neighbors on both sides had submitted letters supporting the request.
No members of the public had signed up to speak during the public comment portion of the meeting. After the board completed its deliberations and vote, the panel adjourned.
