The resolution authorizes appointment of appraisers and negotiators, allows the city manager to establish just compensation in accordance with law, and authorizes the city attorney to file condemnation proceedings if negotiations do not succeed. The measure was presented as consistent with the city’s professional services agreement with the civil engineering firm and the project schedule.
“Negotiations are not successful, it may be necessary to institute condemnation proceedings,” staff said in the staff report included in the agenda packet. Council voted to adopt the recommended resolution and authorized use of eminent‑domain powers if needed.
