The senator and supporters said ethylene oxide is widely used in medical-device sterilization and certain medical procedures, is heavily regulated, and that the bill is designed to raise pleading standards to deter frivolous lawsuits while preserving legitimate claims of gross negligence.
Kelvin Cullimore of BioUtah testified in support, saying Utah is a significant producer of medical devices and that ethylene oxide is critical to sterilization processes; he cited EPA language indicating negligible risk for low-level environmental exposures under typical conditions. Carmen Valdez of HEAL Utah spoke online in opposition, saying the bill could reduce industry accountability and make it harder for affected residents to seek redress; she cited community concerns and prior local cases.
Senators and committee members debated the legal standard; the sponsor said an earlier senate amendment had required clear-and-convincing evidence, but the committee-level substitute reduces that to the ordinary civil standard (preponderance of evidence) and does not bar legitimate claims of harm. The committee voted unanimously to recommend SB 266 favorably.
