Councilman Wiggins moved the resolution, which identifies the parcel in the Levi Pruitt survey, McLennan County, and authorizes the city to use eminent domain under Government Code §2206.053 if negotiations cannot secure the fee‑simple right‑of‑way. The motion was seconded and the council approved the resolution unanimously.
City staff told the council that the right‑of‑way is needed to construct the sewer improvements and associated road work; staff will continue negotiations with the property owner and pursue condemnation only if necessary. The resolution initiates the legal finding required under state law to support a condemnation proceeding and does not itself convey title.
The council directed the city attorney and city staff to pursue negotiated acquisition first and to use the eminent‑domain authority only if negotiations are unsuccessful.
