The Town Council of the Town of Indian River Shores voted unanimously on two marijuana-related ordinances and approved the consent agenda by roll call.
On a second reading, the council adopted Ordinance No. 5764, which prohibits smoking marijuana within the town (the ordinance title was read into the record). Vice Mayor Atwater moved the motion and Council Member Carroll seconded; Mayor Foley, Vice Mayor Atwater, Council Member Carroll, Council Member Altieri and Council Member Dane voted "aye," and the clerk recorded the motion as passing unanimously.
On a first reading, the council approved Ordinance No. 577, a marijuana dispensary ordinance. The item received a first-reading approval by roll call; the motion and second were entered on the record but the transcript does not name the mover. The vote was unanimous: Mayor Foley, Vice Mayor Atwater, Council Member Carroll, Council Member Altieri and Council Member Dane voted "aye." Because Ordinance 577 passed first reading, any required second reading or subsequent steps will follow the town’s normal ordinance-adoption process.
The consent agenda (Item 5) — which included resolutions requiring roll call — was also approved by unanimous roll call earlier in the meeting: Mayor Foley, Vice Mayor Atwater, Council Member Carroll, Council Member Altieri and Council Member Dane all voted "aye," and the clerk noted the motion passed unanimously.
Votes at a glance
- Consent Agenda, Item 5: Approved (unanimous roll call) - Ordinance 5764 (prohibition on smoking marijuana) — Second Reading: Approved; mover: Vice Mayor Atwater; second: Council Member Carroll; outcome: approved unanimously - Ordinance 577 (marijuana dispensary ordinance) — First Reading: Approved by roll call; mover/second not specified in transcript; outcome: approved unanimously
Why this matters: The smoking prohibition clarifies allowable conduct and enforcement for marijuana smoking within the town. The dispensary ordinance establishes local regulatory conditions for marijuana retail operations; because it passed first reading, additional procedural steps remain before final adoption.
