Urban Affairs committee approves drive‑thru permit for Adena Cafe at 420 Maple Street with conditions

The City Council Urban Affairs Committee voted 4-0 to approve a special permit allowing a single drive‑thru window at an existing building at 420 Maple Street, where the petitioner proposes Adena Cafe. Petitioners Charlotte Maynard and Christian Berrigan attended the February 19 hearing and presented a draft decision and site plans previously reviewed by the Site Plan Review Committee.

Committee members reviewed and discussed manager and department comments from the Board of Health, Fire Department, Police Department, conservation and sustainability staff, and the city engineering division. The record on file includes architectural drawings by Lafredia Architects (10/31/2024) and a site plan by Sammy Oates Consulting (10/30/2024). City engineers requested pavement markings, signage, and a right‑turn‑only restriction on the northern Maple Street driveway; the applicant agreed to those improvements and to engage civil and traffic engineers for design plans.

The committee approved a set of conditions addressing site compliance, hours, lighting, landscaping, parking and maintenance, trash enclosures, speaker/noise controls, delivery hours, and snow removal. Key conditions discussed include:

- Traffic controls and pavement markings to be reviewed and approved during site plan review; engineering recommended rewording to require final review and approval by the City of Marlborough in accordance with applicable rules and the Manual on Uniform Traffic Control Devices.

- Hours of operation for the cafe and drive‑thru were clarified in committee as 5:00 a.m. to 9:00 p.m. Monday through Sunday (applicant confirmed the intent during discussion).

- Drive‑thru audio speakers must use an automatic level‑adjusting pedestal system and “shall not produce noise at the rear property line of the plaza…greater than that which would be allowed in a residential zone pursuant to the noise ordinance of the City Of Marlborough,” to mitigate impacts on nearby Walker Street residences.

- Deliveries by semi‑trailers are prohibited between 7:00 p.m. and 7:00 a.m.; trash dumpsters must be covered and screened and pickups are restricted to daytime hours; landscaping must conform to the final site plan and may be revised by the Site Plan Review Committee.

Committee members raised operational concerns including winter snow‑banking and tight turning radii in the existing configuration, sight‑line issues near the southern entrance and exit, and queueing in the drive‑thru. Several members asked that the city solicitor review draft condition language, particularly a proposed “non-severability” clause (condition 17) that would void the entire decision if any single condition were struck by a court. The chair said the solicitor will be asked to reword or remove that clause as appropriate.

The committee voted 4-0 to recommend the special permit and to forward a revised draft decision to the city solicitor for final edits and formal referral to the full City Council.
