The Metropolitan Planning Commission on Feb. 27 voted to disapprove a rezoning request to IR (industrial restricted) to permit towing and vehicle storage at a property where commercial and automotive uses are nearby.
An owner/operator described current towing operations and said neighboring parcels include towing companies, repair shops and auto‑oriented uses. He said vehicles are held on site temporarily and described notification and disposition procedures for impounded vehicles.
Staff recommended disapproval citing inconsistency with the adopted policy for the area. Commissioners noted the site is surrounded by some legally nonconforming auto‑oriented uses that predate current policy, but that those existing uses’ legal status does not establish consistency for new zoning changes.
Commissioner Clifton moved to approve staff’s recommendation to disapprove the rezoning; the motion passed. Commissioners discussed that existing nonconforming businesses remain allowed under state and local rules but that rezoning to a zone permitting broader heavier industrial uses would be inconsistent with policy for new development.
What’s next: The applicant may revise and resubmit or pursue other zoning pathways; the currently existing neighboring automotive businesses retain legal nonconforming protections unless they cease operations for the statutory period.
