Board reaffirms code of ethics after divided debate over enforcement language

The Spotsylvania County School Board reaffirmed its code of ethics on Jan. 13 by a vote of 5–2 after a lengthy discussion and a failed substitute amendment to add a non-discipline declaration.
Board member Megan Phelps proposed (by substitute motion) adding language stating the board “shall not use the code of ethics for disciplinary or punishment,” arguing the addition would protect members from punitive uses of the code. The substitute was debated at length; opponents said enforcement and disciplinary procedures are addressed in a separate board policy (BBC, “Process for addressing board member violations of school board policies and code of ethics”) and that changing the code itself would create policy conflicts.
The substitute motion to add the non-discipline declaration failed on a 3–4 vote. The original motion to reaffirm the code of ethics then passed 5–2. Members who opposed the substitute said any substantive change to enforcement practice should be handled through the BBC policy and brought forward as a formal policy amendment at a work session, not folded into the code at the reorganization meeting.
Board members also referenced past disciplinary actions and the existence of an independent BBC process; several members asked that discussion of any policy changes be scheduled for a work session so staff and policy language could be reviewed and aligned across related policies.
The board’s formal reaffirmation will be included in the minutes and the board agreed to revisit enforcement procedures during committee/work-session review of aligned policies.
