The San Rafael Planning Commission on Feb. 25 denied an appeal in part and approved a modified reasonable-accommodation approval for 131 Valley View Avenue, voting 5-0 to adopt the amended plan set submitted Jan. 13, 2025 and the findings and conditions attached to that amendment.
The action overturns parts of the planning director's Oct. 17, 2024 approval while replacing it with the amended project plans and conditions requested by staff. The appeal had argued there was no nexus between the property owner's disability and the requested modifications, that alternatives had not been adequately considered, that the changes increased fire risk, and that the process denied due process rights.
Staff presented the project as a request for a reasonable accommodation under the Federal Fair Housing Act and the California Fair Employment and Housing Act to allow modifications to an existing single-family residence to accommodate a resident with a disability. Associate Planner Renee Naconega and Planning Manager Margaret Cavanaugh Lynch told commissioners the original approval addressed six municipal-code factors used by the city to evaluate such requests and that, after the appeal was filed, the applicant submitted corrected plans on Jan. 13, 2025 that preserve the existing roof height and correct earlier plan errors. Staff recommended denying the appeal in part and approving the amended project.
