Council approves temporary and permanent easements at Wild Wing Park for Northern Integrated Supply Project

Timnath’s Town Council voted Feb. 25 to approve Resolution No. 16, Series 2025, authorizing a temporary construction easement (40 feet) and a permanent 60-foot waterline easement for the Northern Integrated Supply Project Water Activity Enterprise (NISP) on town-owned land at Wild Wing Park.
Town staff presented a map showing the easement corridor immediately west of Colorado Boulevard. Under the memorandum of agreement included in the packet, NISP would construct a 48-inch steel transmission water pipeline. Staff said the earliest construction is expected in summer 2026, though 2027 is also possible. NISP offered just under $45,000 in compensation for the combined easements; staff and the town attorney noted NISP agreed to restore surfaces and landscaping if it must access the line after the town builds park improvements (including a planned parking lot).
Town attorney Carolyn explained NISP has condemnation authority as a water district and could pursue eminent-domain proceedings if the parties did not agree; the negotiated terms add protections and require restoration of park improvements if NISP returns for maintenance. Council members asked about how the easement payment was calculated; staff said the figure was based on fair-market appraisal and customary easement-percentage methodology (permanent easement roughly 50% of land value; temporary easement a smaller percentage).
A motion to approve the resolution carried by voice vote, 4-0.
