City staff told the magistrate the violation cites City of Deltona ordinance section 18‑3 adopting the Florida Building Code, Section 105.1, which requires an owner or authorized agent to apply for and obtain a permit before constructing or altering a structure. Staff said corrective action is to obtain the required permit for the roof structure and that permit applications must be submitted to the City of Deltona at 2345 Providence Boulevard, Deltona, Florida 32725. Staff also said photographs and other evidence had been marked as exhibits and that notices were sent by certified mail and posted on the property and at City Hall at least 10 days before the hearing.
The magistrate verbally continued the case to the next month at the city's request. No monetary fine or compliance deadline was issued at the hearing because the case was continued.
The prosecution and evidentiary material on record included staff testimony and certified photographic exhibits. The transcript records staff saying the case was opened on 04/29/2024 after a construction project in progress was observed with no permit on file and that a notice of violation was posted 06/16/2024.
If the case returns to hearing, staff indicated the corrective action remains the same: obtain and provide the permit number to the city and have the structure approved at final inspection.
