The Livingston City Council voted unanimously to remove agenda item 10, which concerned the formation of a Measure L oversight committee, and postponed that item to the council’s second March meeting on March 18. The vote came during a special meeting called to consider several items and to convene a closed session.
The postponement followed a brief explanation from the presiding official that the language in the agenda item could be read as authorizing formation of the oversight committee immediately; the official said the item should be rephrased to indicate discussion and potential direction and recommended moving the item to the March 18 meeting. A motion to pull item 10 from the agenda and postpone it to March 18 passed 5-0.
The council then recessed into closed session at 6:06 p.m. to consider multiple matters under the California Government Code. Staff read five closed-session items for counsel: anticipated litigation under Government Code section 54956.9(d) (four matters); public employee appointment under Government Code section 54957 (title: interim city manager); pending litigation under Government Code section 54956.9 (Jose Ramirez v. City of Livingston, case no. 22CB0082); threats to public services or facilities with consultation under Government Code section 54957(a); and a liability claim under Government Code section 54956.95 (claim FR102723, claimant Marlene Aguilar) seeking monetary compensation for vehicle damage.
During roll call, a staff member noted, “For the record, all council members are in attendance.” The presiding official closed the public portion by saying, “And, we will adjourn into closed session at 06:06, and we'll be back to report out.” No public comments on closed-session items were made in the chamber or by phone, and no other agenda changes were proposed at the meeting.
