Judge rules resolution to form landfill steering committee out of order; court will not vote
Summary
A motion to place a resolution forming a steering committee to study current and old landfill properties back on the agenda was moved in committee but was ruled out of order by the presiding officer, who cited the county administrative code assigning committee appointment authority to the judge executive.
At a February fiscal court meeting, a finance-committee chair moved to place Resolution 2025‑042 — forming a steering committee to study land use at the current and old landfill — back on the court’s agenda as a voting item.
“As chairman of the finance committee, I move to place resolution 20 25 dash 0 4 2 back on the agenda as a voting item,” the motion said. The motion was seconded.
The presiding officer ruled the resolution out of order and declined to allow it to be considered, citing the county administrative code. The presiding officer said only the judge executive may establish or appoint fiscal-court committees and therefore the court would not vote on the resolution that day.
A county-attorney exchange followed, with the presiding officer saying the decision stood and the court would not address the resolution at that meeting. The motion therefore received no vote on the floor and the resolution was not taken up.
No formal vote was recorded to put the resolution back on the agenda; the presiding officer indicated the matter could be addressed at the next committee meeting instead.
