The Board of Zoning Adjustments of Decatur City approved a 6.37-foot rear-yard setback variance under Section 25-5-10.92(d) to permit a sunroom addition at 3115 Farmington Road SW.
Danielle Dodd, homeowner at 3115 Farmington Road SW, told the board she and her family have lived in the house for 28 years and need additional space; she said the planned sunroom would provide that space and that a privacy fence already surrounds the backyard. Board members questioned the precision of survey measurements; one board member advised the applicant that the contractor’s survey is exact and that any approved variance cannot be exceeded (for example, a variance of 6.37 feet cannot later be built to 6.75 feet without returning to the board).
Planning and building staff offered no comment at the hearing. After public testimony closed, a motion to approve the variance “as submitted” passed on roll call with five affirmative votes. The board recorded votes of yes from Erica Huber, Mark McCurry, Flora Gonzalez, Tom Polk (listed in portions of the transcript as Tom Poult/Polk) and Delaine Dean. A board member stated that the variance “stays with the property.”
