The Peabody City Zoning Board of Appeals on a continued hearing approved the applicants' revised plan for 19 Roosevelt Ave on the condition that they receive approval from the Peabody Conservation Commission.
Matthew and Maria Morrissey appeared at a continued hearing for 19 Roosevelt Ave and presented a new plot plan the board said it had received only at the meeting. Board members said the new plan differed significantly from the plan advertised in the legal notice and flagged several procedural and substantive issues: the board requested time for building inspectors to review the revised plan, noted that revised dimensions created new variance needs, and said the change might require re-advertising. Conservation staff informed the board the proposed right-side addition lies closer to wetlands and appeared to fall within the 100-foot buffer zone, which would trigger Conservation Commission review and an order of conditions if work proceeds in that area.
After discussion the board moved to close the public hearing and voted to approve the application with the explicit condition that the applicants obtain approval from the Conservation Commission. A roll-call vote recorded the following: Keith, yes; Chris, yes; Jamie, yes; Barry, yes; Fran, yes.
Board members said they had asked the applicants to consider moving the addition to the other side of the house at an earlier meeting; the applicants presented a new plan that moved the bulk of the addition to the right side but kept a smaller left-side addition that would still require variance relief. The board and staff advised the applicants to coordinate with the building department and the Conservation Commission; the board noted final actions remain contingent on those outside approvals.
The board's decision will be filed with the city clerk and is subject to the standard 20-day appeal period under Massachusetts General Laws, Chapter 40A.
