Mayor Villasiana presented a proposed amendment to the city ordinance governing ground-floor uses in a development that would change an existing limit from 20% to 60% of a building’s ground floor for fast-food uses with a drive-through, and would add a restriction that no building may have more than one drive-through.
Villasiana said the change is needed to align zoning language with a pending development agreement on the council agenda for second reading; the original ordinance assumed a single larger building, while the updated development plan divides the site into four outparcels that could otherwise each accommodate substantial fast-food frontage. "This is necessitated because the original language was put in there when the building was large... and the project changed to four out parcels," Villasiana said. He added the draft also includes a clarifying sentence: "in no event shall any building have more than one drive through" to reduce potential traffic concerns.
Council President moved a floor motion during committee to send the proposed ordinance amendment to the planning commission for formal review; Councilmember Kelly seconded. The committee recorded a roll-call vote in which Councilmember Kelly and Councilmember Curiosus voted yes; the measure will proceed to the planning commission for consideration before second reading at council.
