The Gardner Board of Health on Feb. 24 voted to table approval of its Jan. 27, 2024 minutes after members raised concerns about the minutes’ phrasing and chronology in an enforcement case involving Anthony’s Liquor.
Board members said the minutes did not clearly record key facts that motivated a motion at the hearing. A board member told the meeting that Anthony’s Liquor paid a fine, had seven days to request a hearing, and that a hearing was subsequently requested on Dec. 4 and granted for extenuating circumstances. The member said the business’ long track record in the community — including no violations for about 20 years — and that track record influenced a motion to reduce a suspension to one day. The member asked that the minutes reflect that context.
Board members discussed wording on page 2 and requested clearer chronology. One member said a sentence in the draft minutes was hard to understand and suggested rewording; the board agreed to revise the minutes to clarify both the hearing request date and the reasons board members considered when making the reduction motion.
No formal roll‑call vote on the underlying enforcement action was taken at this meeting. The board agreed to hold the minutes until the revisions are made and to return the matter to the next meeting.
