County rejects latest settlement terms in Boone Creek Plumbing dispute; attorneys to proceed with lawsuit if no acceptable revision

County leadership told commissioners on Feb. 24 that settlement talks over the Boone Creek Plumbing dispute are no longer at the stage the county had expected. The county mayor reported receiving an email from the county’s trial attorneys that altered the previously negotiated framework; as a result he recommended the county not proceed with a settlement motion that had been planned for the meeting.
The mayor said county negotiators believed they were roughly 95% of the way to agreement before the latest communication from the other side’s attorneys. Because the new proposal contained changes the mayor said the commission likely would not accept, the county will reject the revised offer and continue with the lawsuit unless the opposing party returns to terms the county previously viewed as acceptable.
The county attorney confirmed that the county would reject the current proposal and, if no acceptable counterproposal arrives, will pursue the suit. The item had been expected to come forward for approval, but commissioners took no immediate settlement action after the mayor’s announcement.
